Neurorights and Documented Harm

Current legal framework, neurotechnological damage typologies and applicable legal framing in Chile and internationally.

What are neurorights?

Neurorights protect the integrity of the nervous system, mental privacy and cognitive autonomy against technologies capable of intervening, monitoring or modifying brain processes without consent.

Chile was the first country in the world to enshrine neurorights at a constitutional level with Law 21.383 (2021). Law 21.719 (2024) on data protection incorporates neurological data as a special category.

Bill 13828-19 — Rejected May 2026

The neurotechnology bill was rejected with a 6-7-0 vote. LIBERTECH actively participated in the legislative process. The regulatory debate continues.

Law 21.719 — Neurological data as sensitive category

Chile's new data protection law establishes reinforced obligations for those who process neurological or biometric data, with increased penalties for unlawful processing.

Technical sheet · AT-09 · Frey Effect

Microwave Auditory Effect (MAE)

Discovered by Allan H. Frey in 1961–62: exposure to low-intensity pulsed microwaves generates auditory perception in the absence of a conventional sound source, through thermoelastic expansion in cranial tissues.

This mechanism has been linked to Havana Syndrome, which affected US and Canadian diplomatic personnel in Cuba (2016–17), China (2018) and other locations. NeuroEthics Research Lab documents civilian cases with this pattern using the SA-09 sensor and PEM methodology, through referral from Fundación LIBERTECH.

Damage Typology and Effects

Forensic classification of damages documented by the foundation. The effects described come from structured victim accounts, specialized literature and TFA-IDDS Observatory records.

Harm that is unseen, but documented

Neurotechnological damage operates in layers. Each layer produces different effects that accumulate over time, often without the victim identifying the cause. What begins as diffuse discomfort can evolve into chronic functional deterioration if not documented and addressed.

LIBERTECH classifies damage into three levels of impact that allow organizing evidence without exposing the complete forensic methodology:

Documentation principle

Every typology presented here has a correlate in cases entered into the Observatory. Forensic details, measurement instruments and validation protocols reside in NeuroEthics Research Lab and are not published on this page.

Cranial zone and central nervous system
Effects on the head and nervous system

The skull and brain are the primary impact zone in most documented cases. Effects vary according to the technology involved, frequency, intensity and duration of exposure.

01

Headache and cranial pressure

Sensation of internal pressure, localized or migratory dull pain. Different from conventional tension headache: does not respond to standard analgesics. May be associated with pulsed MW exposure.

L0 BiophysicalAcute → Chronic
02

Atypical tinnitus / MAE

Auditory perception without sound source. Sharp, pulsating or variable tone. May coincide with the Frey Effect (pulsed microwaves → thermoelastic expansion). Present in most documented TFA cases.

L0 BiophysicalPersistent
03

Cognitive alteration

Difficulty concentrating, "brain fog", short-term memory loss, verbal articulation problems. Effects that appear in clusters and subside when exposure ceases.

L1 NeurocognitiveEpisodic → Progressive
04

Sleep dysregulation

Insomnia without apparent medical cause, abrupt awakenings at regular times, non-restorative sleep, REM cycle alteration. One of the first and most consistent symptoms reported over time.

L0 BiophysicalL1 Neurocognitive
Gastrointestinal system and gut-brain axis
Documented gastrointestinal effects

A recurring finding in Observatory cases is the presence of gastrointestinal symptoms that the victim does not initially associate with exposure. Scientific literature on the gut-brain axis sustains the plausibility of this connection.

GI

Gastrointestinal syndrome associated with exposure

Recurrent abdominal pain, nausea, altered intestinal transit, abdominal distension. Symptoms that appear in synchrony with documented exposure episodes and subside upon changing location or context.

L0 BiophysicalGut-brain axis
GI

Metabolic and nutritional alteration

Abrupt loss or increase in appetite, new food intolerances, significant weight change without dietary cause. Effects that may be secondary to induced chronic stress or direct interference with the enteric nervous system.

L0 BiophysicalL1 Neurocognitive

Gut-brain axis: why it matters

The vagus nerve directly connects the digestive system with the brainstem. Exposure to electromagnetic fields can alter intestinal motility, mucosal permeability and microbiome composition. These mechanisms are documented in peer-reviewed literature, although their relationship with directed attacks requires specific forensic research that NeuroEthics Lab is developing.

Temporality of harm
Possible progression of damage over time

Cases with the longest follow-up time in the Observatory allow identifying evolution patterns. The following table summarizes the observed progression — without revealing the specific forensic indicators used by the PEM ecosystem.

Phase Estimated period Observed effects Layer
Acute phase 0 – 6 months Tinnitus, headache, insomnia, anxiety, nausea. Symptoms the victim attributes to stress or environmental causes. L0
Consolidation phase 6 – 24 months Persistent brain fog, chronic fatigue, GI disturbances, progressive social isolation, first medical consultations without diagnosis. L0 L1
Chronic phase 2 – 5+ years Measurable cognitive deterioration, neuropathic pain, electromagnetic sensitization, complex PTSD, pathologization by health system, accumulated relational and occupational damage. L0 L1 L2
Neutralization phase Variable Instrumental psychiatric diagnosis, professional discredit, involuntary commitment, loss of support networks. Biophysical damage remains invisible behind the clinical label. L2

Why does temporality matter?

Early recording with tools like the Forensic Logbook allows establishing the temporal correlation between exposure and symptoms before the health system intervenes with a diagnosis that, in many cases, closes the door to forensic investigation. Documenting from the first symptom is the difference between a validatable case and one that is lost.

Dual-purpose technologies · Analytical framework

Dual-Use Technology

The technologies we document were not designed for abuse — but they can be used for it. This section presents the framework LIBERTECH uses to identify, classify and contextualize these technologies without exposing forensic protocols.

What does "dual use" mean?

A dual-use technology is one designed with a legitimate purpose — medical, scientific, defensive military, industrial — but which can be redirected for surveillance, control or harm to individuals without their consent.

The concept does not imply that all technology is dangerous. It implies that certain technologies lack sufficient safeguards to prevent their abusive use, and that current regulatory frameworks do not contemplate their potential for neurocognitive harm.

LIBERTECH does not reveal which specific technologies it documents in each case. What it presents here is the classification framework that allows organizing evidence and referring it to NeuroEthics Research Lab for forensic analysis.

LIBERTECH Classification

Each category groups technologies with similar mechanisms of action. The cards present the domain and type of effect — not the specific models, manufacturers or state providers that the PEM ecosystem documents internally.

Convergence with Artificial Intelligence

AI does not just automate processes — it transforms the very nature of neurotechnological harm. This section presents how the convergence between AI and dual-use technologies creates a scenario that current regulation does not contemplate.

From tool to autonomous ecosystem

Until recently, neurocognitive damage technologies required human operators, specialized equipment and physical proximity. AI integration changes all three variables simultaneously:

Attack automation: Systems that identify biometric patterns, adapt emission parameters and optimize effects without continuous human intervention. What previously required a trained operator can now be executed as an algorithmic process.

Scalability: AI allows a single system to affect multiple targets simultaneously, prioritizing, alternating and adapting in real time. The concept of "individual victim" transforms into "target population".

Opacity: The deep learning models that optimize these systems are black boxes. Forensic attribution — already difficult with conventional technology — becomes exponentially more complex when AI mediates between the operator and the effect.

PEM convergence model
How AI transforms the chain of harm

Each link in the neurotechnological harm chain is enhanced by an AI component. The model is not linear — it is a cycle that feeds back and learns from the target.

C1

Sensing and identification

IoT networks, mobile devices and environmental sensors feed AI models that identify the individual and characterize their electromagnetic environment. The home ceases to be a refuge and becomes an interface (→ AT-12/EBCI, AT-15/RTS).

InputAI: classification
C2

Profiling and modeling

Collected data builds a cognitive-behavioral digital twin of the target. ML algorithms predict physiological responses, tolerance thresholds and temporal vulnerability windows.

ProcessingAI: prediction
C3

Adaptive execution

Directed energy systems, instrumentalized telecommunications or environmental modulation execute with AI-optimized parameters. Real-time feedback allows adjustment of frequency, intensity and cadence.

ActionAI: optimization
C4

Algorithmic concealment

Generative AI produces cover narratives: medical reports that redirect to psychiatric diagnoses, discrediting content on social media, and manipulation of digital records. The victim faces a system that automatically delegitimizes them.

CoverageAI: generation
Implications for governance
Why science policy must address this now

The AI-neurotechnology convergence is not a future scenario — it is operating today with commercially available technology. Current regulatory frameworks were not designed for this level of integration.

Identified regulatory gaps

  • Neurorights law (Chile, 2024) does not contemplate AI as a cognitive harm vector
  • AI regulations (EU AI Act, LATAM proposals) do not address convergence with directed emission technologies
  • Mental health protocols do not distinguish between endogenous pathology and induced neurotechnological damage
  • Cybersecurity frameworks do not cover attacks on the electromagnetic spectrum that affect cognition
  • Conventional weapons treaties (CCW) exclude low-intensity directed energy weapons

What a science ministry can do

  • Fund independent research on biological effects of AI-mediated EM exposure
  • Include convergent neurotechnology in the technology risk assessment agenda
  • Create intersectoral technical roundtables: science + health + defense + telecommunications
  • Require neurocognitive impact assessment in dual-use technologies funded with public resources
  • Establish forensic referral protocols for cases the health system cannot explain
Documentary framework
PEM ecosystem documents addressing convergence

About LIBERTECH

Chilean foundation for ethical validation and neurorights defense. Ethical gatekeeper for cases of non-consensual biophysical intervention, in alliance with NeuroEthics Research Lab.

Mission and institutional role

Fundación LIBERTECH acts as an ethical gatekeeper for cases of neurotechnological harm: evaluates the merit of each situation, establishes whether there are grounds to initiate forensic documentation, and refers to the corresponding technical laboratory.

Technical documentation — PEM v11 application, SA-09 sensor operation, expert reports — is the exclusive responsibility of NeuroEthics Research Lab SpA, an independent allied laboratory. This separation guarantees the integrity of the forensic chain in any judicial process.

Why is this separation important?

An organization that denounces and certifies its own methodology is exposed as "judge and party." The LIBERTECH (ethics) + NeuroEthics Lab (technical) architecture produces a forensic chain that withstands judicial challenge: they are distinct entities with distinct roles.

LIBERTECH is the ethical gatekeeper for cases. The Ethics Committee is the gatekeeper's gatekeeper: an independent collegiate body that reviews whether admission criteria are fair, whether the Observatory operates rigorously, and whether the foundation acts in coherence with its mission.

This three-layer architecture — NeuroEthics Lab (technical) · LIBERTECH (ethical validation) · Ethics Committee (independent oversight) — is what makes the forensic chain withstand judicial, academic and media scrutiny.

Unpaid role, high impact

Committee members do not receive fees. Their contribution is their name, judgment and network. In return, they participate in the body that defines the ethical standards of the first Latin American forensic framework for neurotechnological harm.
